A - Terms of Use


1. INTRODUCTION

Use of this Website implies full acceptance of the terms and conditions as set out below (the ‘T&Cs’). The present T&Cs are intended to define the terms and conditions for using the site. These terms and conditions may be modified or supplemented at any time. Users will be asked to accept the new applicable terms and conditions the next time they use the services or, following advance information about the modification of said T&Cs informing them of the upcoming introduction of such modifications and enabling them, if they so wish, to terminate their use of the services.

The Site is usually accessible 24 hours a day and 7 days a week. An interruption due to technical maintenance can however happen. Accessibility may also be interrupted in the event of force majeure or technical difficulties. The website publisher may not be held responsible for malfunctions of the network or servers or any other event beyond its control, which could interfere with or hinder access to the services.

Practitioner & Website Publisher: Hélène BONAVITA 

User: refers to any physical person, of legal age and capacity, using the Site, under their own responsibility and who has previously accepted the present terms and conditions.

Personal Data: information collected by the Publisher in the context of operation of the Site which may directly or indirectly identify a User.


 
3. PRESENTATION OF THE "ELEVATE FENG SHUI " SITE
 
3.1 GENERAL PRESENTATION OF THE SITE


The purpose of the Site is to provide Users with information on the services provided by the Practitioner 

The information featured on the Site is not exhaustive. It is provided subject to modifications introduced since it has been put online.


4. CONTRACTUAL LIMITATIONS REGARDING TECHNICAL DATA


The User of the Site agrees to access the Site using recent equipment, with an up-to-date browser, and without any viruses.
 
5. INTELLECTUAL PROPERTY
 
All elements of the Site, its general structure, hierarchical organisation, and also the software, texts, animated or non-animated images, sounds, expertise, graphics and all other components of the Site are the exclusive property of the Publisher who holds the usage rights, and are protected under intellectual property law.

Any reproduction, presentation, modification, publication, adaptation of all or part of the website's elements, regardless of the means or process used, is prohibited, unless prior written authorisation is provided by the Publisher

Any unauthorised use of the website or of any of the elements it contains shall be considered as an infringement and will be prosecuted in accordance with the provisions of articles L.335-2 et seq. of the Intellectual Property Code.

The extraction and reuse of content of databases featured on the Site are protected by provisions of the law of 1 July 1998 regarding transposition in the intellectual property code of the European Directive of 11 March 1996 relating to legal protection of databases. As such, any reproduction, reuse or extraction of the database content shall incur the liability of the User.
 
6. LIMITATION OF LIABILITY
 

The Practitioner's services are not intended or offered as a replacement for medical, financial, or legal advice. The Client shall always consult with the appropriate qualified professional for their concern, and follow their advice without delay, regardless of the content of the Practitioner's consultations.

The Practitioner's services are provided for educational and informational purposes only and solely as a help tool for the Client's own use.

 

The Practitioner endeavours to provide as accurate information as possible on the Site. However, the Practitioner is only bound by an obligation of means regarding the accuracy of information provided and shall not bear any liability for omissions, inaccuracies, imprecisions and lack of updates, whether they are due to their own actions or to third party partners who provide them with this information.

Furthermore, the Practitioner shall not bear any liability in case of incompatibility between the information provided, the services offered and the needs of the User.

The Practitioner reserves the right to modify the Site content at any time and without warning, interrupt or suspend all or part of the features of the Site at any time and without warning; and the User shall have no recourse against the Practitioner. The Practitioner shall not bear any liability for consequences of these modifications and interruptions.


The User is liable to the Practitioner and/or third parties for any material and/or immaterial, direct and/or indirect damage, of any kind caused by the User and/or their representatives due to use of the Site contrary to these terms. The User guarantees the Practitioner against any demand, claim and/or recourse of any kind which results from any violation of these provisions.

The Practitioner shall not bear any liability in case of use contrary to the T&Cs.

Furthermore, the Practitioner reserves the right to temporarily or permanently refuse access, without any warning, to services to any User who does not abide by the present Terms and Conditions.

Use of the Site is at the sole risk of the User.

The User acknowledges that they are fully aware that the data cannot be fully protected against all forms of intrusion (hacking). The User acknowledges that it is impossible to guarantee total security of data transmitted.

Consequently, the Publisher shall in no circumstances be liable for any direct or indirect damage including but not limited to infection by viruses, loss of data or programmes, loss of use of IT equipment (including software, hard disks or any system), financial losses (such as loss of a deal or loss of an opportunity) following a visit or use of the Site.
 
7. INFORMATION RELATIVE TO PERSONAL DATA


As part of the operation of the Site, the Publisher may collect some personal data. This will be processed in accordance with law 78-17 dated 6 January 1978 and European regulation 2016/679 dated 27 April 2016.

The Personal Data is for the Practitioner which is also the data controller.

Personal Data collected by the Site helps in the running of services offered by the Site. It allows the Practitioner to provide the services the User asked for.

8. HYPERTEXT LINKS AND COOKIES


Insertion of hypertext links to any part of the Site is prohibited without written prior authorisation from the Publisher

The Site may contain a number of hypertext links to other sites or applications, used with the authorisation of the Publisher

The Publisher is unable to verify the content of sites and applications visited in this way, and consequently will not accept any liability.

Browsing of the Site is likely to lead to the installation of cookies on the User's computer. A cookie is a small file, generally made up of letters and numbers, left by the browser and stored on your device when you visit a website. The data obtained in this way is intended to facilitate later browsing on the site and is also intended to enable various measurements of visits.

9. INVALIDITY OF A CLAUSE

The invalidity in whole or in part of one or more of the provisions of these Terms and Conditions, under the terms of a legal or regulatory provision or a legal decision that has become definitive does not mean the invalidity of the other provisions or the part of the provision that is not invalid.

11. APPLICABLE LAW AND ASSIGNMENT OF JURISDICTION 

Any potential dispute including relating to the application, execution, interpretation and/or validity of the Terms and Conditions and/or use of the Site and/or services offered, where an amicable solution cannot be found, will be subject to French law. Exclusive jurisdiction is granted to the competent courts of Marseille, FRANCE
 

B - Terms & Conditions of Sales

Definitions

The Practitioner refers to Hélène BONAVITA

The Client refers to any person of legal age and with legal capacity, who places an order for service(s) under their sole responsibility and has previously accepted these general terms and conditions of sale.

1. Pricing, Orders & Payment

The price of each consultation is specified in the quote provided to the client. It is a net price (VAT not applicable, article 293 B of the French CGI).

The Client places an order by returning the signed quote via email, with the words "Read and Approved" written on it.

 

The Client agrees to pay the full price stated on the quote as soon as the order is confirmed.

Payment must be made by bank transfer (bank details available upon request). In the absence of payment, no service is owed.

2 Date of Service

The consultation date will be scheduled a minimum of 15 days after receipt of:

The signed quote and payment.

The elements necessary for the analysis (completed form, floorplans, photos and videos of the premises, etc.).

...whichever date comes last. 

The consultation may take place online (video conference) or on-site, subject to travel expenses at the Practitioner's discretion.

3. Modification, Cancellation, Postponement, or Absence

1/ By the Practitioner

The Practitioner reserves the right to postpone or cancel a consultation (on-site or online) in case of force majeure. The client will be notified as soon as possible. In case of a postponement, a new date will be proposed by the Practitioner.

If the Practitioner cancels, the full amount of the service will be refunded to the Client, provided they share their bank details.

2/ By the Client

The Client has a period of fourteen days to exercise their right of withdrawal. This period begins on the date the contract is concluded (article L. 221-18 of the French Consumer Code), namely the receipt of their email agreement and signed quote.

After this period, no cancellation will be accepted.

As an exception, if the Client wants the performance of the service—the consultation—to begin before the end of the withdrawal period, the Practitioner will obtain a specific written request from the Client as well as their waiver of the right of withdrawal once the Practitioner has fully performed the contract.

In the case of force majeure, the Client has the option to postpone their consultation a minimum of 48 hours before the scheduled date. If a postponement is requested more than 2 times and the consultation still can't take place, the service will no longer be owed, and no refund will be possible.

4. Confidentiality and Intellectual Property

All documents presented or given to the client during consultations are protected by intellectual property law and may not be reproduced, communicated, or distributed under any circumstances without the prior written consent of the Practitioner.

5. Arbitration in Case of Dispute

The rights and obligations of both parties related to a consultation order are governed by French law.
The parties agree to submit to the non-exclusive jurisdiction of the Tribunal de Marseille, FRANCE, for all disputes concerning the interpretation or execution of this agreement.
